Understanding Mediation

Mediation is a voluntary and non-binding process of facilitated negotiation, where a divorcing couple comes to agreement on the terms of their divorce, including child custody, child support, spousal support/alimony and property division. The court must approve the terms of the settlement agreement in order for it to become binding on both parties.

In mediation, I act as the neutral third party, helping the parties arrive at an agreement. I do not represent either party, and I do not provide individual legal advice. I help the parties understand the many elements involved in divorce, present creative options for the parties to consider in coming to agreement and give them a realistic picture of what to expect.

Once the parties reach an agreement, I aid the parties in drafting the paperwork to file with the court. This includes a memorandum of understanding relative to the terms of any agreements reached during mediation. At that point, the parties may each retain their own legal counsel to review the paperwork and represent them at the court hearing as they deem necessary.
